Creedon PLLC Wins $22.5 Million Award for Viahart Toy Company Against Counterfeiters
Creedon PLLC attorneys Mark Killingsworth and Charles Wallace have successfully obtained an award of over $22.5 million against product counterfeiters. These defendants were using Viahart Toy Company’s trademarks and copyrighted images to sell low-quality counterfeit items on platforms such as AliExpress, Alibaba, Amazon, eBay, Joom, and Wish—causing damage to Viahart’s business and goodwill in the process.
To avoid liability for counterfeiting, many of these defendants hid their true identities in seller profiles, used false contact information, and worked from overseas locations such as China. Our firm effectively obtained court approval for electronic service, secured identifying information by subpoena, and demonstrated the ongoing damage to Viahart’s business. The court awarded Viahart $22.5 million in damages with full recovery of attorney fees, and granted a permanent injunction against the defendants. Further, the court ordered all seller platforms and associated payment processors to transfer defendant funds as part of satisfying this judgment.
